Firm History


The Bennett Law Firm is a Professional Corporation engaged in the practice of law on a national basis. We appreciate the opportunity to present to you information regarding the legal services rendered by the Firm. The purpose of this Firm History is to provide information regarding the Firm's areas of practice, attorneys, and other matters relevant to the Firm's operation.

The Bennett Law Firm, either through its attorneys or through its "Of Counsel" relationship with former General Counsel of the State Bar of Texas, Captain Steve Peterson and Former Assistant United States Attorney and Board Certified Criminal Law Specialist Skip Cornelius has the capability of providing a full range of litigation services to all manners of business entities, individuals, and organizations in the following areas of the Law:

Medical Industry Representation

The Bennett Law Firm represents health care providers and organizations in criminal as well as civil matters. Increased governmental scrutiny in pharmaceutical industry marketing and pricing practices has recently resulted in special scrutiny of health care provider prescribing and billing practices.

The Bennett Law Firm is currently representing healthcare organizations and providers under investigation by the U.S. Department of Health and Human Services in connection with the activities associated with the TAP Pharmaceutical investigation and settlement. The government alleges that numerous physicians across the country conspired with pharmaceutical sales representatives to illegally bill Medicare and HMOs for inflated drug prices and the sale of promotional “free samples.” Other pharmaceutical companies are also under investigation. Our firm is working closely our clients and U.S. Department of Health and Human Services to resolve these maters of health care providers and organizations who were unintentionally connected with these activities.

Professional Misconduct & Grievance Defense

The Bennett Law Firm has extensive experience representing professionals accused of professional misconduct, including but not limited to - doctors, lawyers, investment bankers, psychiatrists, psychologists, nurses, pharmacists, accountants, bankers, students and academicians. We represent professionals before licensing and regulatory boards and courts of law in criminal and related civil and administrative matters - with particular reference to the professional confronting allegations of substance abuse, sexual misconduct, billing irregularity or professional negligence.

With the assistance of former State Bar General Counsel Steve Peterson, the Bennett Law Firm has nearly 50 years of combined experience representing attorneys in grievance hearings thru out the State of Texas. Representation also includes matters before the Texas State Board of Law Examiners and Disability Hearings. Often Insurance companies have hired the Bennett Firm to represent their attorney insurers who are facing disbarment matters and liability issues.

Legal Malpractice

The Bennett Law Firm has prosecuted numerous cases against attorneys in the State of Texas. Where attorneys have failed to file a document, let a deadline pass, or failed in keeping a conflict of interest from affecting their representation, compensation may be possible for the former client. With some exceptions, a legal malpractice law suit must be brought within two years from the violation. The party that has been wronged must file the lawsuit within that time period. Personal Injury

The Bennett Law Firm has handle a broad range of personal injury cases from automobile accidents to complex product liability lawsuits. The cases include, Suits against New Home Builders, home siding litigation, care facility and nursing home negligence as well as wrongful death actions. Other cases involve premises liability or inadequate security matters involving apartment complexes, restaurants, bars, where patrons and residents have been assaulted, sexually assaulted, or where attacks have resulted in deaths or murders and personal injuries. With most personal injury cases, the injured party has two years from the time of injury to file a lawsuit. There are some exceptions to the two year rule but you should not wait.

Product Liability

The Bennett Law Firm has handled product liability cases in Texas and numerous other states. Since the early 1990s, the Firm has developed a special expertise in handling ATV recreational vehicle cases. Clients have been severely injured and killed when parts failed on these vehicles or due to their inherent instability. Criminal Law

The Bennett Law Firm has extensive experience representing professionals accused of white collar crimes, including but not limited to - doctors, lawyers, investment bankers, psychiatrists, psychologists, nurses, pharmacists, accountants, bankers, students and academicians. Our goal in representing individual clients whether persons or entities to defend each with the utmost expertise and compassion. We will always try to win acquittals where possible, and where conviction seems inevitable, to obtain alternative sentences or treatment rather than imprisonment, and to insure that individual civil rights and liberties are zealously protected.

Employment Law

The Bennett Law Firm has extensive experience working with professionals to resolve employment law issues. All of the Firm’s attorneys and those associated as Of Counsel have published in professional journals, and the writing of appellate briefs is undertaken where appropriate. The Firm's trial attorneys are member of the Texas Trial Lawyers Association, the Association of Trial Lawyers of America, and various criminal defense lawyers organizations. These memberships allows the trial attorneys to stay current on recent litigation developments. The Bennett Trial Attorneys have participated in numerous civil and criminal trial advocacy courses to enhance their practice skills, and they have served as instructors in trial practice seminars.

Firm Commitment

Our goal at the Bennett Law Firm is to provide clients with competent, timely, and cost-effective legal services. Accordingly, prior to billing the Firm's clients and prior to estimating legal fees for the Firm's services, the Firm's attorneys consider a number of factors, including the nature and complexity of the legal work performed or to be performed and the time required to complete the same to the client's satisfaction. The Firm endeavors to charge legal fees that are deemed fair both to the client and to the Firm.

If the case or matter is to be handled on a contingency arrangement or a mixture of hourly and contingency, a written contract will provide the terms of the engagement. Each case is different and changes to the retainer agreement may need to be done so that all involved will understand the terms of the engagement.
