A Texas jury has awarded $13.4 million in a case
involving a 1984 Honda ATC 200S three-wheeler. The plaintiff was rendered a paraplegic when the ATC
"plowed" off the roadway and over an embankment. The complaint charged the ATC was defective due to the lack
of a limited slip differential, which could have been done cheaply
and would have made it safer to turn. Former Consumer Products Safety Commission Commissioner
Stuart Statler of Washington, D.C. testified on behalf of the
plaintiff regarding his warning the public in 1985 about the
instability and inherent danger such vehicles presented to its
riders. Barrera v. Honda Motor Co., Ltd., et al.AIEG members Randall Reeves and Bob Bennett of Houston,
Texas represented the plaintiff.
